Both Apple And Samsung Face Disappointments From Latest Court Rulings



Two weeks ago, we told you how Apple and Samsung were returning to the courtroom to work out some of the remaining details stemming from this summer’s billion-dollar ruling against Samsung. Each side had some issues it wanted the court to address, which would affect just where things would go from here. Would Samsung get a new trial thanks to claims of jury misconduct? Would the judge increase the damages awarded? While there are still some issues pending, Judge Koh just ruled on a couple of the big questions these companies posed, and neither side got quite what they were hoping for.

Samsung is not going to get its new trial. Despite allegations of misconduct by the jury’s foreman, Koh was unswayed by Samsung’s arguments, and the original verdict will stand.

Apple will not get a sales ban on infringing Samsung products. While the court accepted that Samsung’s actions have cost Apple sales, the impact they’ve had hasn’t prevented Apple from being a successful force in the market itself, and so an outright ban would be an unnecessary overreaction.

This is far from the end of Samsung and Apple’s legal squabble, and in addition to the outstanding issues remaining to be resolved with this case, the companies are engaged in separate legal struggles.
